1. Overview
Welcome to Ocean ID (“Ocean ID,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, applications, and services (collectively, the “Services”). By creating an account or using the Services, you agree to be bound by these Terms.
If you do not agree, do not use the Services.
2. Eligibility
You must be at least 16 years old (or the minimum age of digital consent in your jurisdiction) and capable of forming a binding contract. If you use the Services on behalf of an organization, you confirm that you are authorized to accept these Terms on its behalf.
3. Account & Security
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use or security incident.
We may require email verification and may suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to:
- Upload content that is unlawful, infringing, defamatory, or invasive of privacy.
- Attempt to reverse engineer, interfere with, or overload the Services.
- Use automated scraping or data harvesting without prior written permission.
- Misrepresent species data, locations, or sightings with the intent to deceive.
We may investigate and act (including removal or suspension) at our discretion.
5. Content & Ownership
- Your Content. You retain ownership of photos, logs, text, and other materials you upload (“User Content”).
- License to Ocean ID. You grant Ocean ID a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and display User Content solely to operate, improve, and provide the Services (e.g., AI identification, duplicate detection, dive logs, statistics).
- Public vs. Private. By default, uploads are private to your account. However, individual images may be used anonymously within the platform to illustrate marine species (for example, helping other users who have not yet identified a species). Your detailed profile information and your full, ordered gallery of uploads remain private by default and are only visible to others if you explicitly set your profile to public. Aggregate, de-identified insights (e.g., rarity percentages) may also be displayed to users or partners.
- Backups & Storage. User Content may be stored with third-party cloud providers. We take reasonable measures to protect it but cannot guarantee absolute security.
6. AI Identification
Our Services may use AI models to identify marine species from images. AI outputs are probabilistic and may be inaccurate. Do not rely on AI outputs for safety-critical decisions (e.g., approaching wildlife, protected species interactions, or restricted areas). Ocean ID does not provide scientific, legal, medical, or professional advice.
7. Community & Conservation
We support responsible diving and conservation. Follow local laws and best practices for marine life interaction, protected areas, and data sharing.
8. Plans, Trials, and Payments
We may offer free tiers, trials, or paid subscriptions (“Pro”). Prices, features, and limits may change. Paid plans renew automatically unless canceled per the platform’s process. Taxes may apply. Except where required by law, fees are non-refundable.
9. Third-Party Services
The Services may integrate third-party tools (e.g., storage, analytics, payment, CAPTCHA). Your use of those tools may be subject to their own terms and privacy policies. We are not responsible for third-party services.
10. Beta & Experimental Features
Some features may be labeled alpha/beta/preview. They are provided “as is” and may be changed, suspended, or removed at any time.
11. Privacy
Our Privacy Policy explains how we collect, use, and share information. By using the Services, you consent to our data practices.
12. Intellectual Property
The Services, including text, graphics, logos, software, and models, are owned by Ocean ID or its licensors and protected by IP laws. Except for the limited license in Section 5, no rights are granted to you.
13. Feedback
If you submit feedback or suggestions, you grant Ocean ID a perpetual, irrevocable, royalty-free license to use it without restriction or compensation.
14. Termination
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or cause risk/harm. Upon termination, your license to use the Services ends. We may retain backups as required for legal, security, or operational reasons.
15. Warranties & Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED (INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT). WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT AI OUTPUTS WILL BE ACCURATE.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OCEAN ID AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY FOR ANY CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS BEFORE THE EVENT OR (B) €50.
Some jurisdictions do not allow certain limitations; in that case, those limitations apply to the maximum extent permitted.
17. Indemnification
You agree to indemnify and hold Ocean ID and its affiliates harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or your breach of these Terms.
18. Changes to the Services or Terms
We may modify the Services or these Terms. If changes are material, we will provide notice (e.g., email or in-app). Continued use after changes become effective constitutes acceptance.
19. Governing Law & Dispute Resolution
These Terms are governed by the laws of Spain, without regard to conflict of laws rules. All disputes shall be resolved exclusively in the courts of Madrid (Spain), and you consent to their jurisdiction and venue.
20. Export & Sanctions
You represent that you are not located in a jurisdiction subject to comprehensive sanctions and will not use the Services in violation of export control or sanctions laws.
21. Children’s Data
The Services are not directed to children under the age specified in Section 2. Do not create accounts for children or submit children’s personal data.
